This paper addresses family law summary trials in Alberta. It discusses the suitability of summary trials and factors to consider in determining whether to proceed by summary trial, including the advantages and disadvantages. Preparation for summary trial, from affidavit evidence to oral evidence, is also reviewed, and procedural issues and considerations are discussed. In addition, tips for client management in summary trials are also provided. This paper includes, as appendices, an application for summary trial template; a family law summary trial order template; statistics for family law summary trials in Alberta; and a summary of reported family law summary trials in Alberta since November 1, 2010.
