Drafting Personal Directives and Enduring Powers of Attorney: Planning for Future Incapacity

Given Alberta’s aging population, drafting Personal Directives (PDs) and Enduring Powers of Attorney (EPA) is an invaluable service more and more clients will need. For that reason, LESA will be presenting the Drafting Personal Directives and Enduring Powers of Attorney seminar in Edmonton on December 2 and Calgary on December 5.

Long-time LESA volunteer Paul Trotter of Calgary’s Miller Thomson LLP is chairing the program. He has been a practising lawyer for 34 years with an emphasis in tax and estate planning. Drafting EPAs and PDs has been part of his practice for many years.

“My experience is that clients are most willing to have these documents prepared to ensure there is a plan in place in the event of incapacity,” says Paul. “I explain that it is like backing up your hard drive.  You hope the event never happens, but cannot fix it after the fact.”

Drafting PDs and EPOAs to Deal with Future Incapacity

The seminar will cover the following topics:

  • Capacity and duties of a lawyer with Paul Trotter
  • Update on litigation relating to PDs and EPAs with Lois MacLean
  • Main indicators of incapacities with Dr. Arlin Pachet
  • Planning, drafting, and issues with Farha Salim

“I think the presentation by Dr. Arlin Pachet will be of special interest because he brings the perspective of a medical professional working with issues of incapacity, and he is retained by lawyers on a frequent basis to assess capacity,” explains Paul.  “He will be able to comment on types of drafting that is helpful to both lawyers and the clients.”
