Keynote Address “The Relationship Between the Judiciary and the Administrative State” | Justice Suzanne Côté, Supreme Court of Canada

In her keynote address, Justice Suzanne Côté of the Supreme Court of Canada will engage in a thematic discussion of the role of the courts in administrative law matters and the boundaries of judicial review. She will address parliamentary privilege, voluntary associations, arbitration appeals, and Henry VIII clauses.

Summary of Vavilov | David Jones QC, de Villars Jones LLP

Discuss the major changes made by Vavilov to standards of review for both appeals and applications for judicial review. Identify areas which Vavilov does not deal with.

Internal Administrative Appeals | Justice Frans F. Slatter, Court of Appeal of Alberta

Examine the standard of review that should be applied by an administrative appeal tribunal when it is hearing an appeal from a tribunal of first instance. To what extent should the appeal tribunal extend deference? Does Vavilov apply?

The judicial review of administrative decisions engaging Charter protections, post-Vavilov.

Review the record in both judicial reviews and statutory appeals. Identify which documents should be referenced, when affidavits are admissible, who has the onus respecting admissibility, when should the record be filed, and practical pointers for preparing the record.
