For personal injury lawyers, “business as usual” means advancing the interests of our clients, many of whom are seriously injured. Over the past nearly 20 years, part of that process has been to deal with the so-called “cap” on general damages for such clients, trying to marshal evidence that often includes proof of serious impairment taking injuries outside of the “cap”. And every so often, there is a change to the legislation, and we must determine how that affects our clients and how we advance their claims. This presentation examines the November 2020 amendments to the Minor Injury Regulation.
