Last week, the Alberta Court of King’s Bench announced several updates to family court process and procedures.
Effective March 16, 2023, the Court of Kings’ Bench will be increasing the income eligibility cap from $70,000 to $90,000 for referrals to Case Resolution Counsel from Family Docket Court. The cap was changed to match the recent income eligibility cap for the Court and Justice Services Family Mediation Service from $40,000 to $60,000.00.[1]
The Courts also announced that the Civil/Family/Commercial Triage Form previously used would be replaced with two new scheduling forms: the Special Chambers Booking Form and the Trial Booking Form. These forms must be emailed to the appropriate coordinator and include any other applicable orders/forms. The Special Chambers Booking Form will be used to schedule a special before an Applications Judge or Justice. The Trial Booking Form can be used after the parties in a family action have obtained a leave in Family Docket Court to schedule a trial.[2]
