An Interview With the Chair of “New Home Construction” From our Upcoming Refresher Course – Real Estate

Robert P. Assaly Q.C. of Ogilvie LLP is chairing our session entitled “New Home Construction” at our upcoming 45th Annual Refresher Course–Real Estate. We chatted with Robert to bring to you further insight into what you can expect from this half-day session.

Robert attended the University of Alberta where he received a B.Sc. in 1972 and LL.B in 1975. He has been with the law firm of Ogilvie LLP since 1979 and as a Partner since 1981. Since being with Ogilvie, his practice has been focused mainly on real estate; both commercial and residential. The majority of his practice in residential relates to new home construction and condominiums. He has been involved in what is now called the Canadian Home Builders Association since 1983, was on the Edmonton board for over 25 years, and was the President of the then Greater Edmonton Home Builder’s Association and also President of Canadian Home Builder’s Association- Alberta.

Speaking throughout this session are Bryce Milliken of Ogilvie LLP, W. Donald Goodfellow Q.C., Schuyler V. Wensel Q.C. of Witten LLP, and T. D. Hamill of Witten LLP.

Bryce Milliken is a real estate lawyer at Ogilvie LLP whose practice is mainly focused on new home construction. Bryce is currently one of the chairs of CBA-Real Estate, Edmonton subsection and also an active member of the Canadian Home Builder’s Association- Edmonton, sitting on a number committees.

W. Donald Goodfellow Q.C. is a well know lawyer in Calgary at his own law firm who is out-spoken as it relates to the Builders’ Lien Act. Donald is looking for the day when he can challenge in court the Royal Trust and Bengert case and the requirements for a builders’ lien holdback.

Schuyler V. Wensel Q.C. is a lawyer with Witten LLP in Edmonton and knowledgeable in the area of consumer protection in the new home building industry. For a number of years, Schuyler left private practice and moved to Calgary to head up the Alberta New Home Warranty Program.

Thomas D. Hamill, is a well-respected lawyer in Edmonton with Witten LLP who is responsible for the legal aspects and coordination in Edmonton of dispute resolutions pursuant to the Alberta New Home Warranty Program.

 

When asked who would find this session useful and why, Robert states, “This session would be of interest to any lawyer practicing in real estate acting for clients purchasing a new home. It will bring them up-to-date on what to watch out for and what you need to do to protect your client who is having a new home built.”

Registrants can expect to walk away with a) an update as to the legal aspects when acting for a builder; (b) what you need to know to protect your client who is purchasing or having a house built by a builder; (c) knowledge of the changes that are coming in regards to consumer protection in the home building industry.

This session will be a refresher and bring you up-to-date on the current practises and legal aspects in acting for either a builder or a purchaser of a new home.
