Tactical Civility

Civility in litigation matters serves multiple purposes. This paper adds to conversations related to civility in the practice of law and outlines why it is important for lawyers to be mindful of civility in professional and personal interactions, and how civility can be, in fact, a tactical advantage. This paper is part of a collection presented at LESA’s Alberta Family Law Institute: Survive, Strive, Thrive program in Calgary on November 28–November 29, 2024.
Kerr v Baranow – The Wages of Sin Revisited

This paper provides a discussion of how the Kerr v Baranow case has been applied in Alberta since 2011. The author includes an analysis of decisions made by the Alberta Court of Appeal and Court of Queen’s Bench from a cohabitation and unjust enrichment perspective to determine how the Kerr decision is being applied in Alberta.

This paper was presented at the Matrimonial Property Division program held in January and February, 2015.
Making Sure the Money Talks, Not Walks

This paper overviews the types of financial-based decisions made in one’s law practice when dealing with clients, such as ensuring money is available to clients from another party and ensuring money is available to counsel from the client. This paper was presented at the 46th Annual Family Law Refresher in April of 2013.
