  • Recent Alberta Family Law Developments in Parenting

    Surveying recent Alberta jurisprudence, this paper provides an update on parenting issues. Topics include: Practice Note 2 and clarification on what can and cannot occur in regular family chambers; how courts have addressed COVID-19 factors; mobility; shared parenting; supervised parenting; reversal of custody cases; and the stay of enforcement test for parenting decisions.   • A Review of the Impact of Illness and Disability on Spousal Support

    This paper provides a review of non-compensatory spousal support, with a particular focus on the impact of illness and disability on spousal support in Alberta. It provides an overview of the statutory framework for spousal support, the Spousal Support Advisory Guidelines, and leading decisions from the Supreme Court of Canada. It also discusses what qualifies as an illness or disability and what evidence is required to substantiate an illness or disability. In addition, considerations for spousal support orders, such as permanence and payment frequency, are discussed. This paper is part of a collection presented at LESA’s Child and Spousal Support 2017 program held in Edmonton on April 4, 2017 and in Calgary on April 11, 2017.
  • Section 7 Special or Extraordinary Expenses: A Review of Case Law and the Maintenance Enforcement Program’s Perspective

    This paper reviews section 7 of the Federal Child Support Guidelines and the Alberta Child Support Guidelines, which allow parents to seek additional reimbursement for special or extraordinary expenses over and above the regular child support amount. In particular, this paper considers the following: calculating income for the purposes of section 7 expenses; determining whether an expense falls under section 7, and if it is necessary and reasonable; determining the onus and evidence needed; and determining extraordinary expenses. In addition, this paper includes a discussion of court discretion, fairness, and consent, and a review of the Alberta Maintenance Enforcement Program in the context of section 7 expenses.
    This paper is part of a collection presented at LESA’s Advanced Child Support program in Edmonton on February 10, 2016 and in Calgary on February 23, 2016.
     
  • How to Avoid Being Rejected: Review of the Top Rejection Reasons at Land Titles

    This paper reviews some of the primary reasons for rejection of documents at the Land Titles office, providing concrete examples as visual aids. The author examines topics like basic rejection, Document Registration Request form rejection, transfer of land rejection, Dower Act rejection, Foreign Ownership rejection, mortgage rejection, fiat rejection, order (Certificate of No Appeal) rejection, and postponement rejection. This paper was presented at the Law and Practice program in November 2013.
  • Sweet Child O’Mine (by Marriage or Court Order) – Step Parents, In Loco Parentis and Child Support Obligations

    This paper was drawn from materials presented at the Child Support Fundamentals seminar held in February 2012. It primarily reviews section 5 of the Federal Child Support Guidelines and the Alberta Child Support Guidelines, under which step parents may incur child support obligations to their non-biological children.
