Civil disputes are commonly resolved through mediation, negotiation, or arbitration. This paper explores these alternatives to trial. Civil disputes are commonly resolved through mediation, negotiation, or arbitration. These alternatives to trial require different considerations, approaches, and skills as to how to deal with the issue of damages. This paper discusses using alternative dispute resolutions, such as mediations and arbitrations, to resolve damages. It provides an overview of the different processes, and includes tips and strategies to employ to best utilize these approaches to resolve damages.
