We are just a short week a away from our upcoming real estate webinar on “Buying and Selling Rural Property: What Lawyers Should Know” with our presenter, Tim Burnham (Burnham Law Group).
Read on to learn a little bit more about Tim, including what motivates him his practice, what he enjoys to do in his downtime, why he volunteers for LESA, and why this webinar is beneficial for real estate practitioners.
Tim completed his law degree at the University of Alberta in 2006 and was called to the Alberta bar in 2007. He holds a Bachelor of Commerce degree from the University of Alberta, serving him well particularly well in corporate and real estate law. Over the past 18 years, he has built his practice with a focus on the general practice of law, including corporate, estates, real estate, family law and litigation. In addition to practicing law, Tim has trained and mentored 7 articling students, managed his law firm operations, and contributed to legal education through teaching and speaking engagements within the legal community.
When not practicing law, Tim is actively involved in the community. He currently serves on the Grande Prairie Police Commission, as it transitions from the RCMP to a municipal police force. He also serves on the Grande Prairie Public School District Education Foundation, helping to enhance educational opportunities for students. On a personal level, Tim enjoys spending time with his family, golfing, watching movies with his wife, and being involved in his faith community.
Motivations
When asked what motivates him in practice, Tim responds:
“Initially I avoided law as a career option as I was concerned about the supposed “conflicts” that could arise in criminal law matters. However, I was required to take some legal courses as part of my commerce program, and found I really enjoyed many of the civil aspects of a legal practice. I was drawn to law because it combines problem-solving, advocacy, and business strategy. I enjoy helping clients navigate complex legal issues and structuring solutions that protect their interests. Seeing the direct impact of my work—whether assisting businesses in strategic transactions, resolving commercial disputes, assisting clients in their real estate matters, and ensuring families have solid estate plans—is what keeps me motivated.”
LESA & Continuing Legal Education
When asked about the role continuing legal education plays in a lawyer’s practice, Tim responds:
“In my experience, LESA plays a crucial role in supporting the development of Alberta’s legal professionals, and I value the opportunity to contribute through teaching and mentorship. Continuing legal education is essential because the legal landscape is constantly evolving and staying informed ensures that lawyers can offer the best advice to their clients while maintaining high professional standards.”
Why This Webinar Matters
Rural property transactions present unique challenges that requires some specialized legal knowledge. Key issues that lawyers should be aware of include:
- Vague or Unusual Contracts – Many rural property deals involve informal agreements, handshakes, or ambiguous contract language, which can lead to significant legal challenges or even disputes.
- Unusual Titles & Encumbrances – From unusual easements, mineral rights, agricultural and surface leases, rural properties often have complex title issues that must be carefully reviewed.
- Tax Implications – Issues like GST on farmland sales, capital gains, intergenerational transfers, corporate vs. personal ownership structures, and non-resident vendors can significantly impact buyers and sellers.
- Unique Financing Programs – Lenders can sometimes take a different approach to financing rural properties, with considerations such as leaseholds, security structures, and agricultural exemptions playing a role.
This webinar will provide practical insights into these challenges and equip lawyers with the tools to better advise their clients.
“LESA programs provide high-value, practical education that keeps legal professionals ahead of industry changes. Whether you are a new lawyer or a seasoned practitioner, these programs offer insights that can directly enhance your practice and client service. In my experience LESA offers the best continuing professional development for lawyers in Alberta.” ~ Tim Burnham
