While the law of causation has been relatively unchanging over the years, it is important for practitioners to continually review the basics of causation to be able to effectively analyze the elements of causation in personal injury litigation. This presentation explores the elements of causation in a tort action, including an examination of the “but for” test, the “material contribution” test, and the remoteness analysis.
This on-demand program was originally presented as an in-person program on May 31, 2023 as part of our Personal Injury and Insurance Update program.
