The video recordings and materials from LESA’s webinar on the new Trustee Act are now available. Originally broadcast as a half-day webinar, the following titles are now available on demand:
- The New Trustee Act: What’s New and What’s Not
- The New Trustee Act: Settlor’s Intentions and Temporary Trustees
- The New Trustee Act: Best Practices for Lawyers and Trustees
- The New Trustee Act: Variation and Termination
As part of this webinar, Donna Molzan KC (Alberta Justice) prepared comprehensive materials on the recently passed Trustee Act (“the New Act”) with a summary of provisions from its former version (the “Prior Act”) that are carried into the new legislation.
Donna’s paper includes notable highlights of the new statute, provisions carried over from the Prior Act, format changes made to the New Act, summaries of detailed provisions, and more. It contains an in-depth overview of key concepts including the variation and termination of trusts, trustee compensation and accounts, and charitable trusts and non-charitable purpose trusts. Donna also outlines the additional powers the New Act has imbued the court and how these powers differ from the Prior Act.
